Epstein works to install 'Cubs Way' this spring

MESA, Ariz. - Theo Epstein and his supporting cast in Chicago are busy installing the "Cubs Way" with his new team. Don't ask him to explain it in a few words, either. It's not that simple for the former Boston Red Sox executive hired to guide the Cubs out of their role as baseball's loveable losers.

Epstein says there were "outstanding" organizational meetings in Arizona this week to develop the specifics of what the "Cubs Way" will be. He says it will amount to few hundred pages.

As the new Cubs president for baseball operations put it: "Playing hard is a big part of it but playing the game the right way and teaching it consistently are as well."

Pitchers and catchers reported to the team's spring training facility in Mesa on Saturday.

"But urgency is important as well," he said. "The goal of the 2012 Cubs is to win the World Series, and our goal is an organization is to build an organization that competes on an annual basis in the postseason and gives ourselves a chance to win the World Series. Patience, yes, but urgency in the sense that I think there's something each of us can do every day to help make the organization better."

The Cubs last won a World Series 104 years ago.

Epstein said the various manuals being put together to illustrate the "Cubs Way" includes things done in Boston but also from the backgrounds of others, including new general manager Jed Hoyer and manager Dale Sveum, both of whom appeared with Epstein at a news conference on Saturday.

"We're going to be teaching the game the exact same way," Esptein said, "everything from what foot you hit the bag with when you're making the turn to how we run bunt plays to what our overall hitting philosophy is."

It's important, Epstein said, to have things written down.

"If you can't articulate for someone what it is you're trying to accomplish, how can you reasonably expect them to get there?" he said. "If you can't write down on paper what it is you're teaching, how can you expect your players to pick it up? How can you expect your A-ball hitting coach to teach hitting the same way as your Triple-A hitting coach and the same way as your major league hitting coach."

Sveum said that there are "a few major things" he will aim for this spring.

"One of the things we're going to harp on the most, you've heard me talk about, is base running," he said, "but we're not creating the wheel here or reinventing anything. It's just refining everything to get things done on an everyday basis. Whether it's the 'Cubs Way' or anybody's way, it's just the right way to do things."

Outfielder Reed Johnson, one of several position players who have arrived early, welcomed Sveum's hard-nosed approach.

"You see Dale and the way that he approaches things and you can tell that he means that," Johnson said. "A lot of coaches and a lot of staff members can say that sometimes, but you can tell it's not genuine and they're really not going to follow through. He doesn't care if you're making $15 million or you're making $450,000, you're going to go out there and play the game hard, and if not you're not going to play."

It's a reaction that doesn't surprise the new Cubs manager.

"I think any athlete wants to be held accountable for what they do," Sveum said. "You can do this in a number of ways. It's not about screaming or yelling, it's just about when mistakes are made, especially on the mental side, that they're taken care of."

Sveum said it appears three of the starting spots in the rotation are nailed down ? by Matt Garza, Ryan Dempster and Paul Maholm ? with competition for the other two as well as a few slots in the bullpen.

"We've got a lot of guys who can throw it," said outfielder Marlon Byrd, another of the early arrivals.

When asked about a long-term contract for Garza, Hoyer declined to be specific but indicated talks could go on this spring.

"We focused really hard on getting a one-year number done a few weeks ago," Hoyer said. "We didn't have any kind of long-term discussions before that. But certainly there was a dialogue about possibly having some long-term discussions at some point, maybe this spring. When we do it, we'll keep it quiet and hopefully their side will, too, because I think contracts are better negotiated that way. But we will probably sit down and talk."

Garza agreed to a $9.5 million, one-year contract just before the scheduled start of an arbitration hearing on Feb. 3. The right-hander was 10-10 with a 3.32 ERA last season after being acquired from Tampa Bay in January 2011.

Epstein said he had no new information on the status of a Chicago police probe into an accusation of sexual assault against shortstop Starlin Castro. Castro has vehemently denied the allegation and no charges have been filed.

Epstein will bring a team of experts from the Center for Sport in Society at Northeastern University to spring training to talk to players about off-field behavior.

The idea, he said, is to "give players the right tools to deal with situations off the field, not only the right decisions to make but the right values to conduct their careers."

In the past 30 years, Dr. Ramirez also has directed dozens of other research programs focused on human and organizational communication to reduce Latino cancer and chronic diseases via risk factor studies, clinical trials and healthy lifestyle changes. Her projects have led to unique health communication models and interventions that have contributed to reducing Latino cancer rates and increasing screening and preventive health behaviors.

The Buffet rule won't work in practice

According to the Buffett Rule the wealthy should pay at least as much tax as middle-income households.?That sounds straightforward but it?s not.

In his State of the Union speech, President Obama?s called for a new law that would require high-income people to pay at least 30 percent of their income in taxes. In response, Senator Sheldon Whitehouse (D-RI) and Representative Tammy Baldwin (D-WI) have introduced the Paying a Fair Share Act of 2012, a proposal designed to meet the Buffett Rule: That the wealthy pay at least as much tax as middle-income households.

That sounds straightforward but it?s not.

First, there?s the matter of how to measure income. The rule would define income as adjusted gross income minus a modified measure of charitable contributions. The adjustment avoids discouraging charitable donations.

Measuring taxes is more complicated. The proposal defines taxes to include the regular income tax, the individual alternative minimum tax (AMT), the employee?s share of payroll taxes that finance Social Security and Medicare, and the 3.8 percent tax on investment income and the 0.9 percent tax on earnings imposed on high-income taxpayers to help finance healthcare. That?s a broader measure than what most people see on their tax returns today, but it still excludes other taxes that people pay indirectly like corporate income taxes and the employer?s share of payroll taxes.

If you make at least $1 million (by the act?s definition) and your tax is less than 30 percent of that, you?ll owe more tax, presumably yet another addition on your income tax return. That?s certainly not tax simplification.

The Tax Policy Center estimates the proposal would increase 2015 taxes for about 116,000 households by an average of more than $170,000, assuming the Bush-era tax cuts expire as scheduled and Congress stops patching the AMT. That?s an overall tax increase of about $20 billion, not chump change but less than a tenth of the projected 2015 deficit. If Congress extends tax law in place this year, about 217,000 tax units would owe an average of nearly $190,000 more, yielding about twice as much additional revenue but still less than a tenth of a larger deficit.

The Buffett rule sounds good in principle. High-income taxpayers should pay at least as large a share of their income in taxes as the rest of us. But most already do. On average, middle-income households will pay 2015 taxes totaling about 15 percent of their income (using the legislation?s definition). Without the Buffett rule, more than 99 percent of millionaires will pay more than that and only about 4,000 will pay less. Barely 10 percent of them will pay less than 20 percent.

The proposed legislation would certainly raise taxes on a lot of high-income taxpayers. But the price would be even more complicated tax code. There are better ways?to raise taxes on the rich.

British man wanted in '93 heist nabbed in Missouri (AP)

OZARK, Mo. ? A British armored car guard suspected of driving off with a fortune worth $1.5 million back in 1993 has been captured in rural Missouri, where he had been working as a cable guy and raising a son who apparently knew nothing of his father's past.

Edward John Maher, now 56, was dubbed "Fast Eddie" in news reports after the heist in England, but he quickly vanished. After nearly two decades as a fugitive, he was arrested Wednesday in an apartment in the tiny town of Ozark, 160 miles southeast of Kansas City, where he had been living under a brother's name, Michael Maher.

In his effort to stay hidden, Maher fled from Britain with his family and may have moved several times within the U.S. Property records suggest he lived in at least four states in New England, the South and the upper Midwest.

FBI spokeswoman Bridget Patton said federal officials do not know what happened to the money.

Maher's guise began unraveling Monday, when Ozark police received a tip that a man going by that name was really a fugitive from Britain. An officer compared his driver's license photo with a picture from 1993 and contacted the FBI, which also compared the photos and determined they were likely the same man.

On the same day, Maher happened to be bailing his 23-year-old son out of jail in the nearby town of Nixa when a police officer told him authorities suspected Maher was wanted in England, but they could not arrest him. Because there were no U.S. warrants for either Michael or Edward Maher, police had no reason to take him into custody.

They arrested him later, after immigration officials determined he was in the U.S. illegally.

According to an FBI affidavit, Maher's son overheard what the officer had said and asked his father about it.

The father "was irate," the affidavit said. "Maher told his son that they would have to leave again and threatened to kill the person who tipped the police off about his identity."

The son, Lee King, had been jailed on some outstanding warrants that police found after a report of a domestic situation. Officers concluded it was just a verbal argument.

The next day, Maher's son was being interviewed by an FBI agent when his father called and said they had to leave immediately. The son refused to go. A short time later, Ozark police officers and federal agents saw Maher, a woman and a boy leaving their home carrying clothes. They were later seen checking into a local motel.

The son contacted the FBI agent Wednesday and reported that his father had changed his mind about fleeing. If officers came to his home to arrest him, the son explained, the father would not resist. Maher was taken into custody a short time later.

He is accused of driving off in an armored car while a fellow security guard was making a delivery to a bank in Suffolk, England. The van was later abandoned. Fifty bags containing coins and notes worth 1 million pounds, or $1.5 million, were missing.

Maher's family reluctantly opened the door to their two-story townhouse Thursday to speak with an Associated Press reporter.

"He's an amazing dad," said King, who said he was Maher's eldest son. "He cares for us, provides for us and takes care of us. He's been to every baseball game, football game. Everything we've ever done in our lives, he's been there for us."

A day earlier, King told Springfield television station KSPR that after his father's arrest, his mother confided to him that he is two years older than he thought and was born in the United Kingdom a few years before the heist.

Maher's wife, Deborah Brett, who also goes by the name of Deborah King, said the family had lived in Ozark for about 4 1/2 years.

She said if Maher is sent back to Britain, family members will go there with him.

"He's a wonderful father and a wonderful husband. He's never hurt anybody. Never caused any harm to anybody," she said, quietly comforting a younger boy who appeared to be about 15 as they both fought back tears.

While investigators were at Maher's home, Brett told them about several guns her husband had purchased since coming to the U.S. She said she didn't want the weapons around and showed officers where to find them in the home and in a storage facility in town.

In addition to immigration violations, federal prosecutors charged him with having illegal weapons.

Property records indicate that someone using the name Michael Maher lived in New Hampshire, mainly in Concord, from 1997 until 2006. He was also connected with homes in Florida, Wisconsin and Minnesota.

Maher made an initial appearance Thursday in federal court in Springfield and asked for a court-appointed attorney because he didn't have enough money to pay for representation.

Dressed in blue jeans and a gray polo shirt, with closely cropped salt-and-pepper hair, Maher appeared calm and respectful during the two-minute hearing. He is in the custody of U.S. marshals and was scheduled for a preliminary hearing Feb. 22.

After being taken into custody, Maher told an FBI agent he had been using his brother's name since 1998, when he began working in the U.S. He said he obtained a Social Security number under that name.

Brett told agents her husband also sometimes used name Stephen King.

In Ozark, Maher had been a cable installer for St. Louis-based Suddenlink Communications.

Pete Abel, the company's senior vice president of corporate communications, acknowledged Maher was an employee but declined to go into details about his duties or how long he had worked there. Before he was hired, managers conducted a background check, which found no evidence of a criminal past, Abel said.

Ozark Police Chief Lyle Hodges praised one of his officers for his persistence after getting the initial tip that Maher was a fugitive. Officer David Overcast did research that revealed the armored car robbery and found a photo of Maher, Hodges said.

Because there were no active warrants, the chief said, "it is entirely possible that another officer might have stopped investigating."

Business owners often make costly mistakes while launching their businesses. It is easy to get so caught up in the excitement of starting your business that you make mistakes that could cost you a great deal of money. Here are five very common mistakes I have seen that could have been avoided with minimum cost.

Failure to Protect Personal Assets

There are several ways to protect your personal assets. The first is to select a legal entity such as a Limited Liability Company (LLC) or corporation that creates a legal firewall separating you from the company. However, this is not foolproof and will never protect you in case of personal negligence or fraud.

Next, make sure you sign your documents correctly. Don?t sign them personally but as an officer of the corporation or LLC with company name (Jane Doe, President ABC Corp). Whenever possible, do not personally guarantee anything. Instead, make the guarantee the company?s.

Maintain the formalities of the LLC or corporation so others can?t pierce the ?corporate veil?. Maintain a separate bank account for the company, separate insurance policies and separate tax returns. Hold the required formal meetings and do the necessary paperwork to keep up your corporate records.

Sign a Bad Lease

Think of a lease as a long term loan. If you sign a five-year lease with a $1,000 per month rent payment, you have, in effect, committed yourself to a $60,000 note. So it is important to understand everything about your lease and negotiate terms that will lessen your exposure.

Try to get as short a lease as possible with options to renew for your desired period. For example, if you want a five-year lease, try to get a one-year lease with two two-year options to renew with specific rent rates.

If possible, make sure you can assign or sublet the space if needed. Your idea may not work or some major life change may necessitate you getting out of the business.

Know what you are responsible for such as replacing the air conditioner if it goes bad. Know who is responsible for the build out. In today?s market, landlords may be willing to front this expense, but get it in writing.

Always have an attorney review your lease to help clarify what you are responsible for and protect you from hidden costs.

Failure to Plan for ?Murphy?

Everyone has heard of ?Murphy?s Law??. ?anything that can go wrong, will go wrong?. I like to add ?at the worst possible time?. I tell all new business owners to be prepared for Murphy to move in with them when they open their business.

The most common ways this happens are construction overruns in time and/or money, financing takes longer than anticipated, and permitting and zoning roadblocks. The important concept here is to realize things will not go exactly according to your business plan. As a new owner, you must expect the unexpected.

No HR Planning

Don?t forget to do your homework when hiring employees. The first thing you need to do is know whether they are employees versus independent contractors. Chances are they are employees. You should have written hiring procedures as well as job descriptions and evaluation procedures.

Always make sure you comply with employment laws and have written employment polices reviewed by an attorney that specializes in employment law. This is a case where an ounce of prevention is worth thousands of dollars of cure.

Lack of an Accounting System

It is critical to start off right with your accounting. I encourage new business owners to hire a CPA to help set up their accounting system. It is cheaper to do it right the first time.

You must make sure your system and software comply with all the payroll and sales tax laws. This is a very complicated area and mistakes here can pierce the corporate veil and become personal liabilities.

Don?t forget that you need accurate and timely financial statements to effectively manage your business.

A little planning can go a long way toward ensuring that your business is off to a good start and that you can handle Murphy?s visit.

Pa. vending machine dispenses 'morning-after' pill (AP)

Students at Shippensburg University in Pennsylvania can get the "morning-after" pill by sliding $25 into a vending machine, an idea that has drawn the attention of federal regulators and raised questions about how accessible emergency contraception should be.

The student health center at Shippensburg, a secluded public institution of 8,300 students tucked between mountain ridges in the Cumberland Valley, provides the Plan B One Step emergency contraceptive in the vending machine along with condoms, decongestants and pregnancy tests.

"I think it's great that the school is giving us this option," junior Chelsea Wehking said Tuesday. "I've heard some kids say they'd be too embarrassed" to go into town ? Shippensburg, permanent population about 6,000 ? and buy Plan B.

Federal law makes the pill available without a prescription to anyone 17 or older, and the school checked records and found that all current students are that age or older, a spokesman said. It doesn't appear that any other vending machine in the U.S. dispenses the contraceptive, which can prevent pregnancy if taken soon after sexual intercourse.

The machine has been in place for about two years, and its existence wasn't widely known until recently. The U.S. Food and Drug Administration is contacting state officials and the university to gather facts, agency spokeswoman Stephanie Yao said Tuesday.

The FDA's sudden interest took place amid a furor over religious rights and access to birth control. An official resigned from the nation's largest breast cancer charity Tuesday over Planned Parenthood funding, and Republican presidential candidates attacked the Obama administration for a recent ruling requiring church-affiliated employers to provide birth control.

Consumers have long been able to insert a few coins for the likes of aspirin, ibuprofen, antacids and other common over-the-counter remedies. But some experts see a worrisome trend in making drugs like Plan B, which is kept behind the pharmacy counter, available in a vending machine.

Alexandra Stern, a professor of the history of medicine at the University of Michigan, said she wasn't questioning a woman's right to have access to Plan B, but whether making it so easily available is a good idea.

"Perhaps it is personalized medicine taken too far," she said. "It's part of the general trend that drugs are available for consumers without interface with a pharmacist or doctors. This trend has serious pitfalls."

Taking Plan B within 72 hours of rape, condom failure or just forgetting regular contraception can cut the chances of pregnancy by up to 89 percent. It works best if taken within 24 hours. Some religious conservatives consider the emergency contraceptive tantamount to an abortion drug.

The idea for a vending machine started at Shippensburg after a survey about health center services several years ago. Eighty-five percent of the respondents supported making Plan B available, school spokesman Peter Gigliotti said. The student government endorsed the idea.

The machine is in the school's Etter Health Center, which only students and university employees can access, Gigliotti said in a statement. In addition, "no one can walk in off the street and go into the health center," he said; students must check in at a lobby desk before being allowed in.

Students and administrators at Shippensburg said they're puzzled that a single vending machine at a small school has attracted such attention. Matthew Kanzler, a senior, said a lot of students at the school weren't even aware of the machine until recently.

Most students do support the idea, he said ? but not all.

"It's a way for students to get the help or care they need," he said, adding that students appreciate the on-campus health care because the school, about 130 miles from either Philadelphia or Pittsburgh, is so isolated.

In December, the Obama administration's top health official overruled her own drug regulators and stopped the Plan B pill from moving onto drugstore shelves next to condoms and other items. It remains available behind pharmacy counters.

Denise Bradley, a spokeswoman for Teva Pharmaceuticals, which makes Plan B, said in a statement that it sells the product only to "licensed pharmacies or other licensed healthcare clinics, which are required to follow federal guidelines for the distribution of pharmaceutical products."

On whether the machine might violate the law, "I don't have a definite yes or no," said Ron Ruman, a spokesman for the Pennsylvania Department of State, which oversees the state pharmacy board. If a person younger than 17 used the machine, it "potentially could be a violation," he said.

The drug isn't covered or subsidized by the school. Its price at the vending machine is set by the school's cost to the pharmaceutical company and is less than at off-campus pharmacies.

Deanne Hall, a professor at the University of Pittsburgh School of Pharmacy, noted that the ease of access to such a machine could be positive for many women, but wondered whether self-treatment might deter sexual assault victims from seeking medical attention.

"This does open up a different door," she said.

Rob Maher, a professor at the Duquesne University School of Pharmacy in Pittsburgh, said he had never heard of a vending machine dispensing Plan B, but noted that there have been vending machines in doctor's offices, and even a specialized machine designed to fill prescriptions.

Still, he questioned whether the machine would make it possible for a young person to buy the drug without discussing their risk factors with a health care professional.

"That's the big risk with a vending machine like this," he said.

Carol Tobias, president of the anti-abortion group National Right to Life, said other services would be more appropriate.

"It would be a much more productive use of funds if universities would partner with local pregnancy resource centers where students can get real help if they need it," Tobias said.

Said Anna Franzonello, counsel to Americans United For Life: "Students at Shippensburg University deserve better than to have their administration represent the potent drug with life-ending potential as no more harmful than any other vending machine item."

Ghana, Mali scrape through to African Cup semis

FRANCEVILLE, Gabon (AP) -Ghana and Mali scraped through to the African Cup of Nations semifinals on Sunday, as Tunisia and Gabon fell in agonizing fashion.

Ghana beat Tunisia 2-1 in extra time after goalkeeper Aymen Mathlouthi's blunder gifted the Black Stars a 101st-minute winner in a tense, bad tempered quarterfinal at Stade de Franceville that the Tunisians had controlled before Mathlouthi's decisive error.

Mali beat co-host Gabon 5-4 in a penalty shootout in the quarterfinal in Libreville after they were level at 1-1 at the end of 120 minutes.

Pierre-Emerick Aubameyang, Gabon's hero of the group stage, missed the decisive spot kick and dissolved into tears in the middle of a huddle of players as the home team's tournament ended in bitter disappointment.

Gabon won its first three games and was six minutes away from a first appearance in the semifinals, only for Cheick Diabate to equalize in the 84th and give Mali the chance to steal victory and a place in the last four in the shootout.

Ghana faces Zambia and Mali plays Ivory Coast in Wednesday's semifinals, leaving top-ranked African teams and tournament favorites Ghana and Ivory Coast still on course to meet in the Feb. 12 final.

"I think we were lucky there," Ghana striker Asamoah Gyan said after his team pounced on Mathlouthi's mistake. "You know in football anything can happen, luck also counts and you see the error the keeper made. I wouldn't blame him, but it happens in football."

Eric Mouloungui scored for Gabon from close-range after Aubameyang's cutback in the 55th minute at Stade de l'Amitie to seemingly continue a dream African Cup for the co-host.

But Diabate turned cleverly and forced his late shot under goalkeeper Didier Ovono to keep a stubborn Mali team alive at the tournament.

Aubameyang, who had also hit the post in normal time, then had his penalty saved by Soumaila Diakite in a gut-wrenching end for the co-host, allowing Mali captain Seydou Keita to step up and send his team through and Gabon out.

Mali's players, led by Keita, celebrated wildly on the running track around the field as the weeping Aubameyang was consoled by team mates and the previously rowdy, joyous Libreville crowd was silenced for the first time in two weeks.

At Franceville, the sparse groups of local supporters spent the buildup to the Ghana-Tunisia quarterfinal with their backs to the field watching the live broadcast of Gabon's game on giant TV screens at the stadium.

The crowd danced and sang at Stade de Franceville and a group of ball boys ran up and down behind one goal doing back flips and somersaults when Gabon took the lead.

Ghana led Tunisia in the 10th minute as John Mensah's rollercoaster ride of a tournament continued when he headed in at the far post from an Andre Ayew corner having scored and been sent off in his country's first game. He later left the field injured.

Saber Khalifa put Tunisia level, but despite holding the upper hand for large parts of the game the North Africans were undone by Mathlouthi's extra-time howler, which allowed Ayew to side foot into an empty net and Ghana to progress.

"It's a pity it ended like this for us," said Mathlouthi, who ironically won the game's fair play award. "It was my fault on every level."

Neither team deserved a fair play award as the match - which was already physical - descended into an ugly end when Tunisia's Aymen Abdennour was sent off for elbowing Ayew, leading to a shoving match near the corner flag between both sets of players.

Issam Jemaa made two reckless challenges in quick succession that went unpunished and Ghana's defense also mercilessly scythed down Youssef Msakni in the final minutes.

"They made a game look like a war," Ghana assistant coach Kwesi Appiah said.

AP Exclusive: US No-Fly list doubles in 1 year (AP)

WASHINGTON ? The Obama administration has more than doubled, to about 21,000 names, its secret list of suspected terrorists who are banned from flying to or within the United States, including about 500 Americans, the Associated Press has learned. The government lowered the bar for being added to the list, even as it says it's closer than ever to defeating al-Qaida.

The size of the government's secret no-fly list has jumped from about 10,000 in the past year, according to government figures provided to the AP.

The surge comes as the government says it's close to defeating al-Qaida, after killing many of its senior members. But senior officials said the threat does not stop there.

"As long as we sustain the pressure on it, we judge that core al-Qaida will be of largely symbolic importance to the global jihadist movement," Director of National Intelligence James Clapper told Congress on Thursday. "But regional affiliates and, to a lesser extent, small cells and individuals will drive the global jihad agenda."

Those are the people added to the no-fly list, current and former counterterrorism officials said. Most are from other countries; about 500 are Americans.

"Both U.S. intelligence and law enforcement communities and foreign services continue to identify people who want to cause us harm, particularly in the U.S. and particularly as it relates to aviation," Transportation Security Administrator John Pistole said in an interview.

Affiliated terror groups in Yemen, Pakistan, Somalia, Algeria and elsewhere, as well as individuals who ascribe to al-Qaida's beliefs ? "All are in the mix," said Michael Leiter, former director of the National Counterterrorism Center. "And no one is claiming that they are shrinking."

The flood of new names began after the failed Christmas 2009 bombing of a Detroit-bound jetliner. The government lowered the standard for putting people on the list then scoured its files for anyone who qualified. The government will not disclose who is on its list or why someone might have been placed on it.

Among the most significant new standards is that now a person doesn't have to be considered only a threat to aviation to be placed on the no-fly list. People who are considered a broader threat to domestic or international security or who attended a terror training camp also are included, said a U.S. counterterrorism official who spoke on condition of anonymity to discuss sensitive security matters.

The Christmas attack led to other changes in how the U.S. assembles its watch list. Intelligence agencies across the government reviewed old files to find people who should have been on the government's terror watch list all along, plus those who should be added because of the new standards put in place to close security gaps.

The Nigerian man who pleaded guilty in the Christmas 2009 attack over Detroit, Umar Farouk Abdulmutallab, was listed in a large U.S. intelligence database that includes partial names and relatives of suspected terrorists. That database is a feeder to the broad terror watch list, of which the no-fly list is a component, but only when there is enough information linking the person to terrorism. Officials believe the U.S. had enough information about Abdulmutallab at the time to put him on the broader terror watch list, which would have helped the intelligence community catch him.

After the Christmas attack, "We learned a lot about the watch-listing process and made strong improvements, which continue to this day," said Timothy Healy, director of the Terrorist Screening Center, which produces the no-fly list.

As agencies complete the reviews of their files, the pace of growth is expected to slow, the counterterrorism official said.

The American Civil Liberties Union has sued the government on behalf of Americans who believe they're on the no-fly list and have not been able to travel by air for work or to see family.

"The news that the list is growing tells us that more people's rights are being violated," said Nusrat Choudhury, a staff attorney working for the ACLU's national security project. "It's a secret list, and the government puts people on it without any explanation. Citizens have been stranded abroad."

The government will not tell people whether they're on the list or why they're on it, making it impossible for people to defend themselves, Choudhury said. People who complain that they're unfairly on the no-fly list can submit a letter to the Homeland Security Department, but the only way they'll know if they're still on the list is to try to fly again, she said.

While the list is secret, it is subject to continuous review to ensure that the right people are on it and that the ones who shouldn't be on it are removed, said Martin Reardon, former chief of the Terrorist Screening Operations center and now a vice president with the Soufan Group. If a person is nominated to be on the no-fly list, but there is insufficient information to justify it, the Terrorist Screening Center downgrades the person to a different list, he said.

"You can't just say: `Here's a name. Put him on the list.' You've got to have articulable facts," Reardon said.

On average, there are 1,000 changes to the government's watch lists each day, most of which involve adding new information about someone on the list.

The no-fly list has swelled to 20,000 people before, such as in 2004. At the time, people like the late Sen. Ted Kennedy were getting stopped before flying ? causing constant angst and aggravation for innocent travelers. But much has changed since then.

While thousands more people are on the list, instances of travelers being mistaken for terrorists are down significantly since the government ? not the airlines ? became responsible for checking the list, Pistole said. Travelers must now provide their full name, birthdate and gender when purchasing an airline ticket so the government can screen them against the terror watch list.

But with the nature of the terrorism threat, it's not likely that the list will dwindle, even as al-Qaida's core leadership is defeated, Reardon said.

"I would argue that even if (al-Qaida) as we know it ceased to exist as of tomorrow, other terrorist organizations or lone wolves with both the intent and capability of carrying out attacks against the U.S. would fill the void," Reardon said. "The consolidated terrorist watch list exists for that very reason."

Once they are identified and placed on the list, he said, "We have a much greater chance of keeping them from entering the country."
